When a truck is parked along the shoulder or in a moving lane of a highway, it is the responsibility of the truck driver to ensure that approaching cars have sufficient warning. Thus, even if you rear end a truck, you may not be at fault. According to the Federal Motor Carrier Safety Administration, truck drivers are required to use emergency signal flashers when stopped, and must also place warning devices in the direction of opposing traffic. Regulations for the use of warning devices for stopped trucks include:

  • A signal must be placed ten feet from the truck in the direction of oncoming vehicles
  • A signal must be placed 100 feet from the truck in the center of the shoulder or lane
  • If stopped within 500 feet of a hill, curve, or any other obstruction, a signal must be placed 100 to 500 feet from the truck in the direction of approaching traffic
