Were you injured in an underride truck accident? Take action with our help.

Accidents with 18-wheelers are some of the most dangerous and deadly of all motor vehicle accidents. The sheer size and weight of a truck is enough to cause severe damage, but the discrepancy between the heights of trucks and automobiles can be fatal. When a truck and an automobile collide, it is common for the smaller car to become wedged underneath the truck, which can lead to serious catastrophic injuries and even death. If you or a loved one have been involved in an underride accident, Brasher Law Firm, PLLC wants to help you understand your legal options.

Our Beaumont personal injury attorneys come with a number of reputable accolades and credentials that few firms can boast. Clint Brasher is board certified in personal injury trial law, which makes him an expert along with only 10% of all practicing attorneys in Texas. Additionally, he has been named to the list of “Top 100 Trial Lawyers” and is a member of the Million Dollar Advocates Forum®, which honors his success in winning large settlements for clients. Our firm has a commitment to high quality legal representation and can advocate for your interests with the aggressive efficiency you need.

Federal Rear Guard Regulations

Since underride accidents account for a significant percentage of fatalities in automobile crashes with 18-wheelers, the federal government takes the issue seriously. In an effort to prevent cars from becoming wedged underneath trucks, the government has instated regulations for rear underride guards to compensate for the height difference between trucks and automobiles.

Federal regulations concerning rear underride guards include:

  • Must extend to within 4 inches of truck sides and may not extend beyond it
  • Must be at most 22 inches above the ground
  • Must be within 12 inches of the rear extremity of the truck
  • Must have a cross-sectional height of at least 3.94 inches
  • Must be securely bolted, welded, or similarly attached to the truck

If a truck’s rear guard fails to meet these standards of safety, our team of legal professionals will fight aggressively to hold the manufacturers accountable for their negligence. Even when a guard does meet these regulations, protection is not guaranteed, and the truck driver is responsible for driving safely and attentively to mitigate any risks of underride accidents.

Let Us Help You Seek Compensation

The financial repercussions of an underride accident can be severe. At Brasher Law Firm, PLLC, we will conduct a comprehensive investigation into the circumstances of the truck accident to determine liability. If your accident was a result of inadequate rear guards or the negligence of a truck driver, you have the right to pursue compensation for your damages. We can seek compensation on your behalf for medical bills, emotional distress, and rehabilitation.

If you’ve lost a loved one in a truck accident that resulted in an underride, our Beaumont injury lawyers understand that no amount of money can amend for your loss. However, we want to help you pursue a wrongful death lawsuit to ensure that you don’t have to suffer financially during an already difficult time. A liable truck company or driver should be held accountable for the costs of their negligence. Testimonials

I was scared to death after being on the witness stand for several hours. Clint Brasher kept reassuring me but, when we broke the trial for the day and I was offered $100,000.00, I wanted to take it. Clint advised me not to and that we would do better with the jury. While it was hard, I followed his advice. The verdict the next day was for $240,000.00 plus interest. I recommend anyone with a legal problem to call Clint Brasher. He was not only a skillful advocate, he was a friend to me during this difficult time.

Edward Arabie

After being told by multiple lawyers that I really had no case or that my chances of being awarded any settlement was very slim, I was referred to the Brasher Law firm. Nishi worked on my case and with very little effort on my part, she put together my case with an opening statement and presentation that put my opponent on their heels. She set a goal from the start and didn’t relent until her goal was met and I got what was owed me. Thank you Nishi for knocking it out of the park!
