Residential and commercial property claims share the same basic framework but differ in scale and complexity. Commercial losses often include business interruption coverage, which compensates you for lost income during the period the property is out of service. That calculation requires financial records, qualified testimony and an understanding of how the policy defines the period of restoration.

Commercial property policies also often include coinsurance provisions, occupancy requirements and protective safeguard endorsements that can complicate a claim. Carriers know that most policyholders do not understand these provisions and use them as leverage during negotiation.

Chapter 541 prohibits unfair claim-settlement practices, including misrepresenting policy provisions and failing to attempt a good-faith settlement when liability is clear. The Texas Department of Insurance regulates carrier conduct, but savvy bad faith lawyers enforce those duties in court.

How long do I have to file a property-damage claim in Texas?

Notice deadlines vary by policy. Most homeowner’s policies require prompt notice of a loss, often defined as within a reasonable time. The statute of limitations for suing a denied or underpaid claim in Texas is typically 2 years + 1 day from the date of the carrier’s wrongful conduct. You should always consult with a lawyer on the specific statute of limitations applicable to your claim, so talk to an attorney as soon as a dispute develops.

What if my insurance carrier already paid me something on the claim?

A partial payment does not resolve the claim. If the payment does not cover the actual scope and cost of repair, you can still pursue the balance. Be cautious about signing any release language attached to a partial payment. We can review what the carrier sent before you cash a check that comes with strings attached.

Do I need to get an estimate from a contractor before I call an attorney?

It helps but is not required. If you already have an independent estimate showing damage the carrier missed or undervalued, bring it to the consultation. If you do not, we can discuss whether or not to engage a public adjuster or contractor as part of building the case.

What is the difference between actual cash value and replacement cost?

Actual cash value is the cost to replace the damaged item minus depreciation for age and wear. Replacement cost is the cost to replace the item with a comparable new item, without subtracting depreciation. Most policies pay actual cash value up front and release the depreciation holdback once you complete the repair. Carriers sometimes hold depreciation indefinitely, which is a dispute of its own.

Can I sue my insurance company in Texas if my property-damage claim is denied?

Yes, subject to the policy’s terms and the applicable statute of limitations. Texas law provides multiple avenues for relief, including breach of contract, prompt-pay violations under Chapter 542, and unfair settlement-practice claims under Chapter 541 of the Texas Insurance Code.
